TopamaxAnticonvulsants, Topamax® and Depakote® are prescription medicines prescribed to treat seizure disorders and to prevent migraine headaches.

Women taking Topamax during pregnancy are 21 more times likely to have infants with oral cleft defects than women who have not taken the drug. In 2013, juries found the company Janssen Pharmaceuticals at fault for not fully warning doctors and consumers about the extent of potential birth defects resulting from Topamax use. “They also determined that the company’s negligence was a substantial factor in causing the plaintiffs’ injuries.”

Abbot Laboratories, manufacturer of Depakote is also in legal trouble after failing to warn the medical community and consumers about the risk of birth defects if taken by pregnant women. Potential birth defects include but are not limited to cleft palate, spina bifida, heart defects and anencephaly.

In 2006, a black box warning was added by the FDA to warn about the potential birth defects. In 2009 the FDA warned that Depakote could also trigger suicidal thoughts and action. In 2010, a study concluded there is a 12 fold increase for infants to have spina bifida if their mothers were taking the drug during pregnancy. In 2011, more studies were conducted and the FDA warned that mothers taking Depakote increases the risk of impairment of their offspring’s cognitive function. “However, this news came too late for many women who took Depakote. After decades on the market, women and their health care providers were not adequately warned about the drug’s risks.”

In 2010, the manufacturers reached an $81 million settlement for illegally promoting the medicine. This number includes a $75 million charge for illegal promotion and a $6 million criminal penalty.
